This vehicle is being sold “as is” with all faults and without warranty, expressed, written or implied. The seller shall not be responsible for the correct description, authenticity, genuineness, or defects herein, and makes no warranty in connection therewith. No allowance or set aside will be made on account of any incorrectness, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. Additionally, the photographs of the vehicle are of the actual vehicle up for auction; however, the color and general appearance may appear differently based on your monitor and color settings. You are hereby advised that it is your responsibility (1) to physically inspect the vehicle, (2) to have satisfied yourself as to the condition and value, and (3) to bid based upon that judgement solely. Therefore, any claims or disputes as a result of, or related to, the failure to disclose or misrepresentation are hereby waived by you. The seller shall and will make every reasonable effort to disclose any known defects associated with this vehicle at the buyer's request prior to the close of sale. Seller assumes no responsibility for any repairs regardless of any oral statements about the vehicle.

Vehicle Pickup & Shipping

All shipping arrangements and charges/costs are buyer's responsibility.

The buyer is responsible for tax, title, and registration.

A bid within a jurisdiction that does not give effect to all provisions of these terms, conditions, and notices are valid in that jurisdiction. You agree to indemnify, defend, and hold harmless the Seller from and against any and all claims, proceedings, damages, injuries, losses, costs, and expenses (including reasonable attorney fees), relating to the purchase of the vehicle that leads to any claim against us by a third party, regardless of the nature of the claim.

The resolution of any and all disputes between Buyer and Seller shall be governed exclusively and in every respect by the laws of the State of Montana without giving effect to the conflict of laws provision of the State of Montana.

In the event of any legal action brought by the Buyer or his/her representative concerning this sale, then the FORUM and VENUE shall be as follows: Before a Montana State Court located in Gallatin County, State of Montana to the exclusion of the courts of any other state, city, municipality, county or locale. Furthermore, Buyer consents to jurisdiction and waives any objection that may be available to any such action being brought in such other courts (including federal courts).

You agree that if any part of these terms, conditions and notices is found to be unenforceable, the remainder of these terms, conditions and notices will remain in full force and effect.
